ORLANDO, Florida (October 24, 2013) -- McKool Smith has secured a $173 million patent infringement verdict on behalf of Jacksonville, Florida-based ParkerVision, Inc. (NASDAQ: PRKR) against San Diego, California-based Qualcomm (NASDAQ: QCOM).
The trial, which was held in two phases, commenced on October 7, 2013 before Judge Roy B. Dalton, Jr. in the U.S. District Court for the Middle District of Florida. The first phase, which addressed invalidity and direct and indirect infringement, ended on October 17 when the jury found that ParkerVision’s patents are valid and that Qualcomm infringed each patent-in-suit. These include U.S. Patent Numbers 6,061,551; 6,266,518; 6,370,371; and 7,496,342, which relate to radio-frequency receivers and the down-conversion of electromagnetic signals. The second phase of the trial commenced immediately on October 17 and concluded today, when the same jury awarded ParkerVision $173 million in damages for Qualcomm's direct and indirect infringement of ParkerVision’s patents.
The McKool Smith trial team representing ParkerVision included attorneys Douglas A. Cawley, Joshua Budwin, Kevin Hess, Richard Kamprath, and James Quigley. ParkerVision was also represented by co-counsel from Smith Hulsey & Busey.
“The jury listened to the arguments closely and carefully weighed the evidence during both phases of the trial,” said Douglas A. Cawley, who served as lead counsel for ParkerVision. “This is a significant win for our client.”
The case is ParkerVision Inc. v. Qualcomm Inc., case number 3:11-cv-00719, in the U.S. District Court for the Middle District of Florida.
