Overview
James Quigley is a Principal in the Austin office of McKool Smith. He is a versatile commercial litigator and trial lawyer focused on patent and technology-related cases. James has extensive federal court experience representing both plaintiffs and defendants in patent-infringement actions. His courtroom victories in intellectual property cases involve a myriad of technologies such as web applications, mobile phones, and integrated circuits. He has been part of teams that have earned their client's jury verdicts and settlements totaling hundreds of millions of dollars.
James has also represented both petitioners and patent owners in inter partes review (IPR) proceedings, including arguing before the Patent Trial and Appeal Board (PTAB) and on appeal at the Federal Circuit. In addition, he has litigated trade secret, trademark, fraud, and breach of contract claims.
James has been named a “Rising Star” by Texas Super Lawyers from 2016-2019.
Before receiving his law degree from The University of Texas School of Law, James attended the University of Wisconsin where he earned a degree in Electrical and Computer Engineering.

- EcoStim v. McIntyre. (SDTX, WDLA) Represent EcoStime in declaratory judgment action against individual and his companies related to alleged patent, trademark, trade secret, and contract claims.
- Egenera v. Cisco. (DMass, PTAB) Represent Egenera in patent infringement lawsuit against Cisco related to virtualized server technology.
- Eolas v. Amazon, Google, Walmart. (EDTX, NDCA) Represent Eolas in patent infringement lawsuit against Amazon, Google, and Walmart involving interactive web technology.
- Cambria v. Wilsonart et al. (ITC) Represented Wilsonart in design patent infringement lawsuit at the International Trade Commission regarding quartz countertops.
- Ericsson v. Apple. (EDTX, NDCA, ITC) Represented Ericsson in a global, portfolio-wide, FRAND licensing dispute against Apple involving LTE technology and other mobile device technologies.
- Unwired Planet v. Google. (DNev) Represented Unwired Plan in patent infringement lawsuit against Google related to mobile device technologies.
- ParkerVision v. Qualcomm (MDFL) Represented ParkerVision in a patent infringement lawsuit involving numerous patents related to direct conversion receiver technology for use in high-performance wireless telecommunications devices.
- Summit 6 v. Research in Motion, et al. (NDTX) Represented Summit 6 in a patent infringement lawsuit against Facebook, Samsung, and others involving digital content processing and uploading technology.
- Droplets Inc. v. Sears & Overstock. (EDTX) Represented Droplets in a patent infringement lawsuit against Sears and Overstock related to rich internet application technology.
- Eolas v. Adobe et al. (EDTX) Represented Eolas in patent infringement lawsuit against Amazon, Google, Yahoo!, Adobe, and others involving interactive web technology
