McKool Smith principal Nick Matich participated on a panel at the recent Federal Circuit Bar Association panel presentation, "Dispute Resolution Challenges: Innovation, Self-Help, and Judicial Systems." Nick spoke about the PTAB’s role in patent disputes and recent developments at the USPTO to improve fairness and efficiency at the Board. Nick observed some inter partes reviews multiply litigation rather than resolve disputes. The PTAB serves the patent system best when it achieves finality for the parties on validity issues and focuses on the disputes in which it can provide a more cost effective forum without duplicating district court actions.
