The American Bar Association is presenting “The Heat is On - Hot Topics in a Sizzling Insurance World” in Phoenix, Arizona on February 14-16. Dirk Thomas, Managing Principal of McKool Smith's Washington, DC office, will participate on a panel titled “Litigation Financing - The Legal and Economic Implications of Third Party Funding of Lawsuits.” The panel will explore ethical issues associated with litigation financing under the model rules of professional responsibility and common law principals, including the application of common law prohibitions of champerty and maintenance to litigation financing; and conflicts of interests potentially raised by third-party financing of litigation. The program will also focus on actual experiences with litigation financing in several recent high profile cases and possibilities for employing litigation financing in insurance coverage disputes.
