Commenting on U.S. Patent and Trademark Office Director Kathi Vidal’s decisions to reinstate OpenSky and Patent Quality insurance as petitioners in the cases OpenSky v. VLSI and Patent Quality Assurance v. VLSI, Washington, DC Principal Nick Matich said that even allowing the proceedings to continue grants Intel a third attempt to invalidate VLSI’s patents, and that letting Intel join the two challenges highlights the problems created by the PTAB’s lack of a standing requirement, which permits anyone to challenge a patent even if they have no stake in the outcome.
