On a petition for writ of mandamus, the court remanded for further proceedings. The district court had granted a motion to modify a protective order to permit documents that were produced in the US litigation to be used in connection with proceedings in Korea and Japan. In so doing, the district court had not considered the issues articulated in 28 USC §1728 and Intel Corp. v. Advanced Micro Devices, Inc., 542 U.S. 241 (2004) and therefore the court remanded for such consideration.
