The California Supreme Court has affirmed McKool Smith's defense win on behalf of global law firm Latham & Watkins and Latham partner Dan Schecter in a malicious prosecution action. The dispute stems from Latham’s representation of Flir Systems in a suit alleging that former executives used Flir’s trade secrets after they left the company. A trial judge dismissed the case, finding it was filed in bad faith. However, the former employees then sued Flir and Latham & Watkins in April 2012, accusing the company and the law firm of maliciously suing them for trade secrets misappropriation.
