On March 10, 2018, Magistrate Judge Roy S. Payne of the U.S. District Court for the Eastern District of Texas reconsidered his order for a new trial on damages, and reinstated a $75 million patent infringement verdict that McKool Smith secured on behalf of Ericsson Inc. and Telefonaktiebolaget LM Ericsson (collectively “Ericsson”) against TCL Communications Technology Holdings Ltd. The Court also awarded Ericsson an additional $35 million, including approximately $10.2 million in prejudgment interest and $25 million in enhanced damages because the jury found that TCL willfully infringed Ericsson’s patent.
The McKool Smith trial team includes Nicholas Mathews, Sam Baxter, Jennifer Truelove, and Warren Lipschitz.
