Business Insurance recently published a report on a lawsuit that McKool Smith filed on behalf of firm client Cushman & Wakefield Inc. against American International Group Inc. (AIG) unit Illinois National Insurance Co. The suit concerns Illinois National Insurance Co.'s alleged failure to fulfill obligations under an excess insurance policy by belatedly reversing its coverage position and refusing to fund the settlement of a covered claim under the policy.
