On September 21, 2015, the United States Court of Appeals for the Federal Circuit issued an opinion affirming a $16.8 million patent infringement judgment that McKool Smith secured on behalf of Summit 6 LLC against Samsung Electronics Co. Ltd. and Samsung Telecommunications America, Inc.
McKool Smith’s original $15 million verdict was announced on April 5, 2013 following a six-day trial before Judge Reed O'Connor in the U.S. District Court for the Northern District of Texas. The jury found that Samsung infringed Summit 6’s patented media uploading technology, U.S. Patent No. 7,765,482, which covers software that automatically processes digital photos before they are transmitted over a network by client devices, such as cell phones. The final judgment ordered an additional $1.8 million in prejudgment interest for a total award of $16.8 million.
