On May 10, 2018, Magistrate Judge Roy S. Payne of the U.S. District Court for the Eastern District of Texas reconsidered his order for a new trial on damages, and reinstated a $75 million patent infringement verdict that McKool Smith secured on behalf of Ericsson Inc. and Telefonaktiebolaget LM Ericsson (collectively “Ericsson”) against TCL Communications Technology Holdings Ltd.
The Court also awarded Ericsson an additional $35 million, including approximately $10.2 million in prejudgment interest and $25 million in enhanced damages due to TCL’s willful infringement.
The original verdict was announced on Thursday, December 7, 2017 following a four-day jury trial in the U.S. District Court for the Eastern District of Texas in Marshall. After 4.5 hours of deliberations, jurors awarded $75 million in damages to Ericsson finding that the defendant willfully infringed Ericsson’s 7,149,510 patent, which covers a method and system for controlling access to a platform for a mobile terminal for a wireless telecommunications system or for another product. The verdict was recognized as a “Top 100 Verdict” of 2017 by VerdictSearch and The National Law Journal.
