McKool Smith successfully secured $3.5 million jury award for our six clients’ breach-of-contract case against Biomet. The contracts at issue were distributorship agreements our clients signed back in the early 1980s with Biomet. Our clients, retired 15 to 25 years, approached us with concerns over the potential impact on their commissions in light of a merger that Biomet announced with another medical device company. Biomet denied underpayment to our clients, hence, the lawsuit followed. “We believed these wonderful guys had been shortchanged in their retirement and they felt powerless to take on a multi-billion dollar company. We were thrilled to take on their case,” said principal Gary Cruciani, lead counsel for our clients.
