McKool Smith, along with Irell & Manella and led by Jason Sheasby, secured a $118 million patent infringement verdict on behalf of Netlist against Samsung, with a jury finding Samsung willfully infringed Netlist’s ‘912, ‘417, and ‘608 patents related to memory module technology, and more specifically, to a concept called rank multiplication.

The verdict was announced on November 22, 2024, following a 5-day jury trial before Judge Rodney Gilstrap in the U.S. District Court for the Eastern District of Texas.

This verdict builds on a previous courtroom victory in which Judge Gilstrap upheld a $303 million patent infringement award secured by McKool Smith and Irell & Manella on behalf of Netlist against Samsung in April 2023. Jurors found that Samsung willfully infringed three Netlist patents related to computer memory technology. The $303 million verdict was recognized as the third largest “Top Patent Damages Awards of 2023” by Law360 and a “Top 100 Verdict” of 2023 by VerdictSearch.

The case is Netlist Inc. v. Samsung Electronics Co. Ltd. et al., case number 2:22-cv-293, in the U.S. District Court for the Eastern District of Texas.
