On December 31, 2024, the Texas Court of Appeals for the Fifth District upheld a jury verdict secured by McKool Smith on behalf of Enterprise Financial Group in a contract dispute against Santander Consumer USA.
After considering arguments from both parties, a three-judge panel concluded that Santander’s appellate issues have been waived or lacked merit and affirmed the trial court’s award in favor of Enterprise Financial Group.
The original verdict was announced in November 2022 following a six-day jury trial before Judge Bridgett Whitmore in Dallas County District Court. Jurors found that Santander, owned by the largest bank in Spain, materially breached a services contract with A+ BBB-Rated Enterprise Financial Group.
