Technology has erased global boundaries, and so has the federal judiciary. Doreen Klein, McKool Smith senior counsel co-authored an article on federal prosecutors' use of criminal grand jury subpoenas to access civil discovery in international investigations for the American Bar Association's Section of Litigation Criminal Litigation Committee Fall 2011 newsletter. As a result of recent decisions by the Fourth and Ninth Circuit Courts of Appeals, the Department of Justice may be able to obtain foreign documents produced in civil discovery that would have otherwise been difficult to obtain through the criminal process alone.
