New York Principal Melissa Cabrera and Houston Managing Principal Josh Newcomer recently published an article in the New York Law Journal, titled “A Domestic Industry in Flux: The Economic Domestic Industry Reporting Requirement.” Josh and Melissa write that recent events, including the Russian invasion of Ukraine and the ongoing pandemic, may give rise to uncertainty regarding a complainant’s domestic investments and an increased use of the reporting requirement in the U.S. International Trade Commission. Their article explains prior ITC precedent addressing the reporting requirement and provides a roadmap of what respondents and complainants should expect when seeking or requesting a reporting requirement.
