Washington, D.C. Principal Nick Matich authored an article on USPTO Director Kathi Vidal’s Director review decisions in Commscope Technologies v. Dali Wireless and AviaGames, Inc. v. Skillz Platform, Inc., noting that while the Director’s statement seemed like a helpful clarification for a “compelling merits” determination, in practice, it “remains confusing.” He added that the decisions “will add uncertainty and more work for IPR practitioners and the PTAB” but will ultimately have little effect.
